These Terms and Conditions constitute the governing rules you accept when purchasing from https://saaspal.us (referred to as the "Website"). You acknowledge that you are legally bound by these terms when you either (i) complete a purchase of any Product, or (ii) utilize any purchased Product in any manner.

Key Definitions

Throughout these terms, the following capitalized terms have specific meanings:

"Purchase Date" refers to the day when a commercial transaction is completed with Saaspal.

"Help Center" refers to any instance of a Zendesk Help Center.

"Intellectual Property Rights" encompasses all proprietary rights, titles, and interests including but not limited to trademarks, patents, and copyrights, recognized globally as of the Purchase Date.

"Product" means any item, subscription, or service available for purchase from Saaspal.

"Product Update" refers to subsequent revisions to a Product released by Saaspal for purposes including, but not limited to, bug fixes or feature enhancements.

"Supported Browsers" includes, unless explicitly stated otherwise, (i) the most recent stable release of Chrome, Firefox, or Safari; and (ii) Internet Explorer 11 and newer versions, as well as the two most recent stable releases of Microsoft Edge.

"Unsupported Browser" means any browser not specified as a Supported Browser.

Licensing Terms

  • Saaspal maintains all Intellectual Property Rights and other proprietary rights to its Products.
  • Product purchasers receive a non-exclusive worldwide license permitting the Purchaser, or a single client of the Purchaser, to create a Help Center using the Product.
  • The license allows installation of the Product in one (1) Zendesk account and all brands associated with that account.
  • Purchasers are not permitted to redistribute, resell, lease, license, sub-license, or offer the downloaded Product to any third party.
  • Purchasers must not provide access to the Product to competing or rival companies.
  • Purchasers are prohibited from adding theme code or portions thereof to publicly accessible repositories (such as GitHub, GitLab, Bitbucket, etc.).
  • Attribution or linking to Saaspal is not required in any Help Centers.
  • Saaspal reserves the right to revoke licenses without refund and require removal of our software from all Zendesk Help Centers managed by the Purchaser if license abuse is discovered.

Support Services

  • Our support team is available to assist with initial Product installation and feature setup as needed.
  • Purchasers are entitled to all Product Updates released by Saaspal throughout the commercial lifespan of the Product.
  • Ongoing support is provided from the Purchase Date, covering setup and use of our software, though this may not extend to troubleshooting custom code written by the Purchaser.

Warranty Information

  • Saaspal guarantees that all Products are developed and maintained according to applicable industry standards, with internal quality assurance reviews conducted prior to commercial release.
  • All Products are designed to be visually consistent and functionally compatible across all Supported Browsers, within reasonable limitations. Where technical limitations prevent certain features or designs, Saaspal will implement reasonable alternatives at its discretion.

Refund Policy

Saaspal offers digital goods that cannot be returned or have access restricted after delivery. Therefore, refunds are not provided once an order is completed and the product is delivered. As a customer, you acknowledge this policy when making any purchase on the Website.

Exceptional Circumstances for Digital Products

Refund requests may be honored under the following exceptional circumstances:

  1. Non-delivery of product: If you do not receive a delivery email due to mail server issues, please contact us for assistance. Claims for non-delivery must be submitted within seven days of purchase, after which the product will be considered received and downloaded.
  2. Download issues: If you experience problems downloading or unzipping the product, you must contact our Support department. Failure to report issues within three days constitutes confirmation of successful delivery with no further refund rights for download issues. Lack of assistance response within three days may result in refund denial.
  3. Irreparable defects: Despite thorough testing, unexpected errors may occur. Such issues must be reported within seven days of purchase. We reserve the right to correct errors within three business days. If we identify a defect as our error and cannot fix it within three business days of the initial complaint, we will either issue a full refund or replace the product with one of equal or similar value. Note that temporary access to your Help Center may be required by our technicians to diagnose and resolve issues. Delayed or refused access may impact issue resolution and refund eligibility.
  4. Product not-as-described: Claims must be submitted within seven days of purchase with clear evidence demonstrating that the product differs from its website description. Complaints based solely on customer expectations do not qualify for refunds. You must provide acceptable proof that the digital product has been deleted before a refund can be issued.

We reserve the right to update, change, or replace any part of these Terms and Conditions at our sole discretion. It is your responsibility to periodically check our website for changes. Continued use of our website or services following any changes constitutes acceptance of those changes.

Due to the nature of digital goods, we recognize this policy could be misused and reserve the right to decline refunds if we determine the policy is being exploited. One-time purchase applications are not eligible for refunds as they are digital goods that cannot be returned.
